These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and The Case Whisperer (“Company,” “we,” “us,” or “our”) governing your access to and use of our website, products, and services, including any digital materials, templates, or coaching sessions (collectively, the “Services”). By accessing, purchasing from, or using this website, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must immediately discontinue use of the website and any associated materials.
All content and materials provided on or through The Case Whisperer, including but not limited to text, images, templates, guides, videos, designs, graphics, logos, and other proprietary content (“Content”), are owned or licensed by the Company and are protected under United States and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your personal, non-commercial use. Any other use, including the reproduction, distribution, modification, resale, republication, uploading, sharing, or transmission of any Content, in whole or in part, without the prior written consent of the Company, is strictly prohibited. You may not use the Content to create derivative works or competing products or services. All digital products, including but not limited to downloadable templates, documents, recordings, or instructional materials, are delivered electronically and are non-refundable once purchased or accessed. By completing a purchase, you acknowledge and agree that all sales are final. You are solely responsible for ensuring compatibility of your device and software with the digital products provided.
If you purchase a coaching, consultation, or live session, you agree to comply with the scheduling, cancellation, and payment terms stated at the time of booking. Sessions canceled or rescheduled with less than twenty-four (24) hours’ notice may be forfeited without refund. The Company reserves the right to modify or reschedule sessions at its discretion with reasonable notice.
The Content and Services provided by The Case Whisperer are for educational and informational purposes only and do not constitute professional, legal, employment, or career advice. The Company makes no guarantees or representations regarding any specific outcomes, results, or employment opportunities arising from use of the Content or Services. You acknowledge that your success depends on your personal effort, background, and circumstances, and you agree that the Company shall not be held liable for any decisions or outcomes based on your use of the Services.
To the maximum extent permitted by law, The Case Whisperer, its owners, affiliates, contractors, and employees shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of the website, Content, or Services. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you hereby consent to the personal jurisdiction of such courts.
